KODAI is a revenue and product intelligence platform for software teams. Depending on enabled features, the Service provides subscription analytics (including Stripe-based insights), issue and error intelligence, and session replay workflows to investigate product problems.

The Service provides aggregated insights such as:

• Subscription, retention, and churn-related indicators
• Customer and payment health insights from connected billing providers
• Issue analytics and error trends
• Session replay data for troubleshooting workflows
• Operational dashboards and trend reporting

You are responsible for configuring and using the Service in compliance with applicable privacy and employment laws.

3. Eligibility

You must be at least 18 years old to use the Service.

By using KODAI, you confirm that:

• You have the legal authority to enter into this agreement
• You comply with all applicable laws and regulations

4. Account Registration

To use KODAI, you must create an account.

You agree to:

• Provide accurate and complete information
• Keep your login credentials confidential
• Be responsible for all activity under your account

We are not liable for unauthorized access resulting from your failure to secure your account.

5. Subscription Plans & Billing

KODAI currently uses an access-based onboarding model. Commercial terms (if applicable) are agreed individually.

6. Cancellation & Refunds

• You may request cancellation at any time by contacting us
• Cancellation timing and end-of-access dates depend on your individual agreement
• Unless required by law or agreed otherwise, payments already due or made are non-refundable

7. Acceptable Use

You agree not to:

• Use KODAI for illegal activities
• Attempt to re-identify individual users
• Collect or process sensitive personal data without a valid legal basis
• Reverse engineer, scrape, or abuse the Service
• Interfere with system security or availability

Violation of these rules may result in immediate account termination.

8. Data & Privacy

You remain the owner of your data. By using KODAI, you grant us a limited right to process data solely to provide, secure, and improve the Service. Data processing is governed by our Privacy Policy, which is an integral part of these Terms. Where legally required, you are responsible for obtaining end-user notice and consent before enabling tracking or replay features.

9. Intellectual Property

All intellectual property rights related to KODAI, including software, branding, design, content, and documentation, remain the exclusive property of kidd.vc. You may not copy, modify, or distribute any part of the Service without prior written consent.

10. Availability & Service Changes

We aim to provide high availability but do not guarantee uninterrupted access. We reserve the right to modify features, add or remove functionality, or suspend or discontinue the Service without prior notice.

11. Limitation of Liability

To the maximum extent permitted by law, KODAI is provided "as is". We are not liable for indirect, incidental, or consequential damages. Total liability is limited to the amount paid by you in the last 12 months.

12. Indemnification

You agree to indemnify and hold harmless kidd.vc from any claims arising from your misuse of the Service, violation of these Terms, or violation of applicable laws.

13. Termination

We may suspend or terminate your account if you violate these Terms, abuse the Service, fail to meet compliance obligations, or fail to pay applicable fees. Upon termination, access to the Service will be revoked and data may be deleted according to the Privacy Policy and your contractual retention terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. Jurisdiction lies with the courts of Germany.

15. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
